In real estate, situs also means area preference: how much buyers want one location over another, the biggest single driver of value.
What Does Situs Mean?
Situs comes from Latin for “position” or “site.” Cornell’s Legal Information Institute defines it as “the location of property or an item for legal purposes.” Merriam-Webster’s legal dictionary adds the reason it matters: the site of property “commonly determines jurisdiction over it.”
So when a document says “the situs of the property,” it’s asking a simple question. Where is it? The answer decides whose rules apply.
Situs in Real Estate Law
Land follows the law of the place where it sits. That rule even has a Latin name, lex situs. The Restatement (Second) of Conflict of Laws §223 says whether a conveyance transfers an interest in land is “determined by the law that would be applied by the courts of the situs.”
Say you live in California and buy a cabin in Idaho. Idaho law decides how that deed works and what kind of title you get, not California law. It’s also why owning land in another state can mean a second probate case there when the owner dies.
Situs and Property Value: Area Preference
In appraisal, situs is one of the four economic characteristics of land: scarcity, improvements, permanence of investment, and area preference (situs). Real estate licensing courses call situs the most important of the four.
Picture this… two identical 3-bed, 2-bath houses. Same builder, same floor plan. One backs up to a park with an elementary school down the street. The other backs up to a highway on-ramp. They won’t sell for the same price. The house didn’t change. The situs did.
Area preference is about people, not dirt. It’s what buyers want right now, so it can shift. A new employer, a new school, or a new trail can make a location more popular. A new truck route can do the opposite. Land itself can’t move (that’s immobility), so outside changes hit its value directly. Appraisers call the negative version external obsolescence, and location is a big part of figuring out a property’s highest and best use.
What Is a Situs Address?
A situs address is the physical street address of a parcel, where the land actually sits. Your county assessor keeps it separate from the owner’s mailing address, which is where the tax bill goes. Pima County, Arizona’s assessor puts it simply: “A parcel’s street address is its situs address.”

For most homeowners the two match. For rentals, vacation homes, and land, they often don’t. If a parcel has no street address yet, which is common with bare land, the situs field may be blank or say something like “No Situs.” Look it up by its APN or legal description instead.
Situs and Property Taxes
Property is taxed where it sits. Idaho’s statute is a clean example. Idaho Code §63-302 says that when a taxpayer’s list includes personal property “having a situs for purposes of taxation in another county,” the assessor sends it to that county’s assessor. Each county taxes only what’s located there.
Real estate works the same way. The county where your land sits sets its assessed value and sends the property tax bill, no matter where you live.
Other Meanings of Situs
Trust situs: the state whose laws govern how a trust is run. People pick it for tax or creditor-protection reasons, and it doesn’t have to be where the trust’s land sits.
